...snip…
Either stick to the policy or revise it the right way. That is all I am asking.
Sounds like we are arguing two different points. You’re right, if it’s changed, then say it’s changed.

To all,
Who wrote the policy? Who agreed to it? Is there an annual requirement for parents to sign it? What happens if it is not signed by parents?

Before too many of you trash the school board for the decision, please keep in mind the very obvious weakness in communication that Dragon exhibits over and over. I know this too well as a former SESD employee. This whole mess makes me wonder - Was the board privy to the pictures to see for themselves the “red cups” vs. the beer cans? Was the board made aware that this letter was anonoymous? Too many unknowns to cast blame.
It also appears many blame the board and many blame the school principal. Is it strangely ironic that Dragon remains an innocent victim in all this? Are people beginning to see a pattern…
Yes it is time for accountability - lets start with the role model at top.

The policy was not written in a vacuum. It was worked out from a pretty standard formula and then agreed on by the board. The board approved the policy by a majority vote. The parents and student sign it every year that thier student particpates in after school activities. If the parents dont sign, thier kids dont participate.

Where can I find the written version of this? I would like to provide it to a local University law student for review.

Just an FYI, the board has a legal counsel (Solicitor) a law school graduate I am pretty sure and he reviews all policies and procedures before they are ever published.

FINALLY - 29 April 2008 04:04 PM Before too many of you trash the school board for the decision, please keep in mind the very obvious weakness in communication that Dragon exhibits over and over. Are you kidding me? Before we cast blame on the superintendent yet again, please check out your facts. THE SCHOOL BOARD HAD THE FINAL SAY IN THIS MATTER, NOT THE SUPERINTENDENT. The superintendent/administration imposed the proper punishment based on the code of conduct that all of the students involved signed. The school board then listened to the whiners and cry babies and voted to change the punishment this time for these students. It is not the superintendent’s fault that our lovely elected school board members voted poorly in this manner.
The role model at the top of this food chain is the SCHOOL BOARD, not our superintendent.
The only pattern that I see is that people continue to cast blame on the wrong person. Get to know the ins and outs of the school board and the way things are handled and this blaming of the wrong party will cease. It is time for accountability from all parties...parents, students, school board members, employees.......

Thanks MarkG.
Also as an FYI, it wouldn’t hurt to have an additional one or two professional opinions to the hired by the board lawyer on this policy. I think I’ll probably be able to find a professional that would agree that it does need to be revised and tell me specific legal guidelines why. Thanks for the info.

I agree. And in response to Finally’s other question. I would imagine that the school board did see the pictures since Fox 43 showed some of them on the news (they didn’t show the faces). Once again, the BOARD suspended the policy for this specific incident, not all together. I think it sort of cuts the Principal and Superintendent off at the knees to over turn their enforcement of a policy that the board has agreed to all these years. I could see, and agree, with a decision that only suspended the punishment for those that were holding red cups, or just had a beer can in the picture they were in. But, the ones that were holding the beer cans and posing with them should have been held accountavble according to the policy. Or, just do away with the policy. Either way is fine with me.
I’m not sure of the legal aspects of this policy because it is voluntary to either sign the policy or not. Unless it contains requirements that are illegal (and this one does the opposite), and it is voluntary, where is the legal issue? Whose rights have been violated?
And to Finally’s comment - “Too many unknowns to cast blame”. uhhhh ....... didn’t you just blame “Dragon”??????

You are right, but I could also find a professional scientist that will tell me that we never walked on the moon if I looked hard enough. That does not make it any less true. My point is that I am sure that the reason the board has legal counsel is to ensure that they are within the bounds of the law before they implement a policy.

Let us not forget who approved this poorly written code in the first place- SHE holds some responsiblity for this. Hands down. The only other option would be to admit that SHE hires inexperienced administrators who can’t turn to anyone for advice who has been there longer than a year or two. Wow...this one really backfired for her, didn’t it? She should bail now, while the public still thinks its all the board and the good old boy’s fault!

Wait a second. There is absolutely nothing that is poorly written about the code of conduct. It is pretty much boilerplate stuff. In the end, the board deals with the punishments, not the sup. Dr. Shank is the one that referred the case to the board in the first place. The board gave the first punishment. Then, under pressure, they buckled. That is the real problem. If you have a personal axe to grind against Dr. S, then you should stand up and say so, not hide behind anonymity throwing stones. You make me sick.
